Global market requirements
Region: Europe and EFTA Countries
Regulator: European Commission
Description: Radio and wireless products sold in the European market must be CE marked. The product must comply with the Radio Equipment Directive (RED). The RED has specific transmitter and receiver tests along with standards such as EN 300 328 and EN 300 220 e.g. transmit power, spurious emissions, bandwidth) along with various EMC emissions and immunity tests per EN 301 489 and EN 301 908.

Legal Requirements:
- The product must be tested to relevant harmonised standards.
- Relevant test reports shall be held by the supplier as evidence of compliance to the RED harmonised standards per the directives
- Suppliers must complete and sign a Declaration of Conformity Statement which lists all the applicable directives and harmonised standards which the product complies with.
- The CE mark must be affixed to the product.
- On the customer’s request, a notified body (NB) can be used to issue a certificate/expert opinion.
- NATA test reports are highly recommended and often required by NBs otherwise products may have to be re-tested locally by an accredited laboratory.
We have our own base station simulators to test virtually all wireless devices. EMC Technologies can arrange NB certificates on your behalf.
RCM (Regulatory Compliance Mark) – Approval of Wireless Devices in Australia
Region: Australia
Regulator: Australian Communications and Media Authority (ACMA)
Description: Radio and wireless products sold into the Australian market must be compliant with relevant wireless and RCM standards such as AS/NZS 4268 and must be labelled with the RCM mark (A-tick/C-tick marks were phased out in 2016). Other general RCM requirements such as SAR/EMR, EMC, Safety and Telecoms standards may also apply.
Legal requirements:
- RCM approval is obtained by demonstrating compliance to the applicable ACMA RCM wireless standards appearing on the ACMA list of Wireless certification standards.
- This may involve specific testing of the product or assessment of similar overseas radio testing reports.
- Depending on the classification (low, medium or high risk) not all products require NATA or ISO 17025 accredited test reports for RCM compliance or RCM certification.
- Many low power transmitters such as Bluetooth and WiFi can be RCM tested under a “class licence” using the Short Range Devices (SRD) Standard 2014 which references short range devices standard AS/NZS 4268. The SRD is also valid in New Zealand without further testing (different limits and other requirements may apply for other devices).
- While not a legal requirement for Level 1 devices, a test report is the safest route and the best evidence of compliance to the relevant Level 1 and Level 2 wireless standards for example ACMA SRD 2014, AS/NZS 4268, IEEE 802.11 abgn, EN 300 328, EN 300 440, EN 301 893. In most cases, additional EMC test reports such as ACMA EMR Standard 2014, AS/NZS CISPR 32 or EN 55032 will be required.
- For Short Range Devices this may be a test report covering the following devices and protocols:
- Wi-Fi

EMC Technologies can assess your reports and advise on other applicable requirements such as EMC and EMR/SAR.
- Where the wireless standards are harmonised between Australia and New Zealand, the RCM label and the same reports are valid in both countries for RCM compliance.
- The Local Authorised representative for RCM compliance, or the supplier in Australia must register on the ERAC or ACMA National Database before they can use the RCM label.
- The Local Authorised representative for RCM compliance or the Australian supplier must complete and sign a Declaration of Conformity (DoC) statement which lists all the ACMA applicable RCM standards which the product complies with.
- The RCM label, or for suppliers registered under the previous C-tick/A-tick regimes, the C-tick or A-tick label must be affixed to the product
- NATA (ISO 17025) accredited test reports ensure report acceptance in the case of dispute with the ACMA.

GURL (General User Radio Licence) – Approval of Wireless Devices in New Zealand
Region: New Zealand
Regulator: Ministry of Business, Innovation and Employment
Description: New Zealand wireless approval is required for various types of radio and wireless devices before they are sold in New Zealand, without the need for the owner to obtain a licence or New Zealand wireless certification in their own name. The Australian approval cannot be used if the applicable standard is not a harmonised Australia/New Zealand Standard. AS/NZS 4268 is harmonised with specific reference to New Zealand GURL limits.
Legal Requirements:
- Telecommunications devices operating in bands covered by a management right are required to meet the requirements specified by the network operator (Spark NZ Ltd, Vodafone NZ Ltd, 2 Degrees etc).
- If the device contains a short range device or it has an AC adaptor for charging purposes the following apply:
- Operate only on the allocated frequencies as detailed in the General User Radio Licence 2014
- Meet the applicable New Zealand wireless standards as per the Radiocommunications (Radio Standards) Notice 2015
- Comply with the Radiocommunciations (EMC Standards) Notice 2004 no 2 if applicable
- Label the product appropriately

FCC (Federal Communications Commission) Approval of Wireless Devices in the USA (United States of America)
Region: North America (USA)
Regulator: Federal Communications Commission (FCC)
Description: Radio and wireless products sold in the US market must comply with relevant sections of the FCC rules such as FCC Part 15.247, based on the type of product. They must also be certified by either the FCC or a designated TCB (Telecommunication Certification Body). The test lab must be accredited by the FCC otherwise the reports will not be recognised. It is strongly recommended that you check the FCC accredited lab list to ensure that the test lab scope includes your required tests.
Legal Requirements:
- The product must be tested to relevant section of the FCC rules by an accredited test lab (the particular transmitter type must be in the scope).
- Relevant test reports shall be held by the supplier as evidence of compliance.
- The FCC labeling and statement must be affixed to the product.
- The accredited test report and associated technical documentation must be submitted to the an FCC designated TCB. A grant is then issued for the product and associated FCC ID number.

ISED (Innovation, Science and Economic Development Canada) Approval of Wireless Devices in Canada
Region: Canada
Regulator: Innovation, Science and Economic Development (ISED)
Description: Radio and wireless products sold in the Canadian market must comply with relevant sections of ISED rules and standards such as RSS-247, based on the type of product. They must also be certified by ISED or a designated Foreign Certification Body (FCB).
Legal Requirements:
- The product must be tested to the relevant standards (such as RSS-247) on a registered test site.
- Relevant test reports shall be submitted to the FCB and/or held by the supplier
- The ISED logo and English/French statement must be affixed to the product
- The test report and technical documentation must be submitted to ISED or a designated FCB
- A grant and ISED number is then issued for the product.

MIC (Ministry of Internal Affairs and Communications) Approval of Wireless Devices in Japan
Region: Japan
Regulator: Ministry of Internal Affairs and Communications (MIC)
Description: Radio and wireless products sold in the Japanese market must comply with relevant MIC regulations in order to comply with JRL (Japanese Radio Law). Certification through a Registered Certification Body (RCB) is required depending on the type of product.
Legal Requirements:
- The product must be tested to the relevant Japanese standards
- Relevant test reports and documentation shall be submitted to the RCB
- The product must be labelled with the relevant MIC compliance logo
